Heard Shri Alok Upasani, learned counsel for the applicant/ petitioner.

The prayer is to review order dated 23.01.2017. In the said order passed in Writ Petition No. 453 of 2017, we have taken note of the orders of the Hon'ble Apex Court in Special Leave Petition (Civil) No. 21454 of 2008 dated 15.11.2010 and specifically observed that only process of selection completed before 15.11.2010 were excepted. 3.

During hearing, the learned counsel for the petitioner has invited our attention to page 179 of writ petition, which is select list of the candidates. It mentions that it was prepared after written examination conducted on 16.11.2010.

We, therefore, find that no case is made out for review. Not only this, SLP filed before the Hon'ble Apex Court against the order dated 23.01.2017 has been withdrawn on 22.09.2017 with liberty to file review application before this Court. Accordingly, review has been filed but there is delay of about 260 days. The reason for

0512cao1755.17 delay is, SLP preferred before the Hon'ble Apex Court. After 22.09.2017, review petition could have been filed within one month but it has been filed on 09.11.2017. The said period after expiry of one month up to 09.11.2017 has not been properly accounted for. Hence, even on that count, we find no case made out warranting condonation of delay. 5.

Accordingly, we dismiss the present proceedings. No costs.
