This writ petition was filed challenging the judgment and order dated 03.09.2016 passed by the learned Civil Judge Junior Division, Balapur, District Akola in Election Petition No.1 of 2015.

(2) The petitioner is represented by Shri R.L. Khapre, learned Senior Counsel whereas respondent No.1 is represented by learned counsel Shri S.D. Chopde. (3) The election was held on 06.08.2015 and in the said election the respondent no.1 was declared as elected candidate from Ward No.3 of Gram Panchayat, Khirpuri (Bk.) Taluka Balapur District Akola. Therefore, the election was challenged by the petitioner by filing election petition. During pendency of this writ petition the term of election held on 06.08.2015 is over and new election is already conducted. Hence, this writ petition is rendered infructuous.
