The learned counsel for the petitioner, at the outset, points out that this Court vide order dated 20.12.2018, directed the Industrial Court, Nagpur to decide the complaint till 15.02.2019. However, after the said order was passed, the respondents filed an additional written statement. In view of the Additional written statement, the petitioner sought amendment to the complaint which was rejected and against the same, the Writ Petition No.925 of 2019 was filed, in which further proceeding was stayed.

It is further pointed out that because of the stay, the direction issued by this Court dated 20.12.2018 could not be complied with.

It is submitted that now the Writ Petition No.925 of 2019 has already been dismissed and as there is no stay to the proceedings, the Industrial Court may proceed with the matter nd.thawre
28wp7101-2018.odt and it can be decided in a time bound manner as directed by this Court.

The learned counsel for the respondent Nos.1 and 2 fairly states that as this Court had already directed to the Industrial Court to decide the matter in the time bound manner, the purpose would be sufficed, if the same direction is issued to the Industrial Court.

Accordingly, I am of the view that the purpose would be served as suggested by both the counsel for the respective parties, by directing the Industrial Court, Nagpur to decide the ULP complaint No.269 of 2016, on or before 30.06.2023. 7.
Stay to the order dated 11.09.2018, granted by this Court vide order dated 20.12.2018 shall continue during pendency of ULP complaint No.269 of 2016.

Both the parties are directed to appear before the Industrial Court, Nagpur on 30.03.2023.

Both the parties are directed to co-operate the Industrial Court, Nagpur to dispose of the matter within stipulated time.
