As a result the application came to be dismissed for default against respondent No.3. Today Shri Tariq Zaheer, learned counsel holding for Shri S. G. Jagtap, learned counsel, appears for respondent No.3. In view thereof, the order of dismissal of application against respondent No.3 stands set aside and the application is restored against respondent No.3.

Heard learned counsel for respective parties. For the reasons given in paragraphs 3, 4 and 5 of the application, as sufficient cause is made out for condonation of delay, the application is allowed. Delay of 125 days in preferring appeal stands condoned. Office is directed to register the appeal.
