DATE : 24.10.2018 Heard Shri Daga, learned counsel for the applicant. Perused the charge-sheet.

The accused/applicant is in Jail since 29.11.2017 and the other two accused are already released on bail. He has pointed out contradictory submissions of debts to the Chemical Analyser. Without going into the merits of the matter and looking to the punishment provided for the excess quantity and small quantity as per Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985, the applicant is entitled for bail. Hence the following order.

ORDER

i] The application is allowed.

ii] The applicant be released on bail on furnishing PR Bond in the sum of Rs. 50,000/- with one local solvent surety in the like amount.

iii] The applicant shall attend each and every date before trial Court.

BA935.18 2/2 iv] The applicant shall not tamper the evidence of the prosecution witnesses and the applicant shall not leave the jurisdiction of the trial Court without prior permission. The application stands disposed of accordingly. JUDGE Andurkar
