DATE : 14/10/2021 Apropos order dated 11.10.2021, Mr. Joharapukar, learned counsel for the respondent No.1 fairly concedes the position as laid down in Ashok Kumar Kalra Vs. Wing Cdr. Surendra Agnihotri and others, 2020 DGLS (SC)195, in view of which, the impugned order dated 29.08.2018, passed below Exh. 22 cannot be sustained, as the same is squarely covered by the majority view in Ashok Kumar Kalra (supra), In view of the above, the application Exh.22 is dismissed. The impugned order dated 29.08.2018 is quashed and set aside.

Petition is accordingly disposed of in the above terms.

Needless to say that the respondent shall be at liberty to take recourse to whatever avenue available in law, regarding claim in Ex.22.
