Rule. Rule made returnable forthwith and heard the learned counsel for the parties.
Shri P. P. Pendke, learned Assistant Government Pleader waives service of notice for respondent Nos.1 and 2. Considering the limited prayer made by the petitioner and the directions proposed to be issued, service on respondent Nos.3 to 5 is dispensed with. 2.
The petitioner who suffers from 85% disability has been appointed on the post of Shikshan Sevak at the respondent No.4School. Since the number of students has decreased, he was rendered surplus and his services were required to be absorbed pursuant to the communication dated 28/08/2023. The petitioner by relying upon the Government Resolution dated 15/12/2004 prays that his services be absorbed at a place near his residence. He has made representations dated 20/10/2023, 31/10/2023 and 08/11/2023 in that regard. 3.
In aforesaid facts, the writ petition is disposed of by directing the respondent No.2 to consider the aforesaid representations in the light of
26-WP-7743-23.odt 2/2 the Government Resolution dated 15/12/2004 and take a decision thereon. The needful be done within a period of four weeks of receipt of copy of this order. The decision be communicated to the petitioner. 4.
Rule accordingly. No costs.
