It is contended that applicant no.2 was already party before the reference Court and was representing applicant no.1. Applicant no.2 is Executive Engineer on applicant no.1. Since applicant no.1 was effectively represented in the reference Court by applicant no.2, there would be no impediment in adding applicant no.1 as appellant and granting leave to file appeal.

In that view of the matter, leave to file appeal is granted. The civil application is allowed and disposed of accordingly. No order as to costs.
