The proceeding against the respondent nos.1 and 3 is already abated.

The application is filed for condonation of delay of 207 days in filing the First Appeal against the impugned judgment and decree passed by the learned Reference Court in L.A.C. No.504 of 2012.

The learned Assistant Government Pleader did not raise any strong objection. On the contrary, despite service, the respondent nos.2, 4 and 5/Claimants remained absent.

In view of the same, the application stands allowed and the delay is hereby condoned, subject to costs of Rs.500 to be paid to the Registry of this Court, within two weeks, for utilization of the Dispensary of this Court.
