Heard learned counsel for the rival parties.

In Crime No.213/2015 for offence punishable under Sections 354, 324, 323, 143, 147, 149 & 144 of the Indian Penal Code and Sec. 8 of the Prevention of Child From Sexual Abusement Act, 2012 registered at Mangrulpir Police Station, Dist. Washim, the applicants were arrested on 7.12.2015 and since then are in jail.

Perused the F.I.R. The learned counsel for the applicants states that the charge-sheet has already been filed after completion of investigation. On careful perusal of the FIR, it is vividly visible that the material allegations are only against the applicant no.1Ganesh Sawant, in respect of serious offence relating to the outraging the modesty and assault on the complainant. The allegations are not against his mother, father and others.

Since the charge-sheet has already been filed, it is not necessary to continue the detention of the

However, so far as the applicant no. 1-Ganesh is concerned, the learned counsel for the applicants undertakes that he would not enter the boundaries of village Umbarda, Tq.Manora, Dist. Washim, till the trial is over and would inform the concerned Police Station wherever he resides. The statement is accepted. Hence, the following order:-

ORDER

a) The applicants be released on bail on their executing PR bond in the sum of Rs.20,000/- (rupees twenty thousand ) each, with one solvent surety in the like amount, by each of them.

b) The applicant no.1-Ganesh Sawant is prohibited from entering village Umbarda, Tq.Manora, Dist, Washim, till the trial is over. The applicant no.1Ganesh is to inform the concerned Police Station where he would reside.

c) The order as regards prohibition of applicant no.1 to enter village Umbarda, be informed by the concerned police station to the family of the complainant.

d) Criminal Application No. 968/2015 shall stand disposed of accordingly.
