By this application, the respondents-claimants states that respondent no.3 Smt. Rukhumabai Sadu Matte and respondent no.5 Sakhubai wd/o Ramchandra Bobade are expired during the pendency of the first appeal. The legal heirs of both the respondents are having a right to sue the proceeding and consequently to withdraw the amount in terms of judgment delivered by this court. Hence, the present application is moved to bring them on record.

Hence, for the reasons stated in the application, the application is allowed. The legal heirs of respondent nos.3 and 5 are permitted to be brought on record. The necessary amendment be carried out within a period of one week. 4.
