26th April, 2016 Shri Karode, the learned counsel for the petitioner, states that the issue involved in this Writ Petition was also involved in a bunch of Writ Petitions bearing Writ Petition No. 6401 of 2015 and others and this Court has, by the order dated 21st March, 2016, partly allowed the Writ Petitions and directed the respondents to continue such of the petitioners that were in employment on 24th July, 2015 and deal with their services as per the policy decision. It is stated that the respondents were permitted to take an appropriate policy decision or to modify the existing policy decision. It is stated that a similar order may be passed in this Writ Petition also.

Shri Nikhil Joshi, learned Assistant Govt. Pleader, appearing on behalf of the State Govt., does not dispute

the statements made on behalf of the petitioner. It is stated that a similar order could be passed on parity. In view of the aforesaid, for the reasons recorded in the order dated 21st March, 2016 in the bunch of Writ Petitions bearing Writ Petition No. 6401 of 2015 and others, we direct the respondents to continue the petitioner if he was in employment on 24th July, 2015 and to deal with his services as per the policy decision. It would be open for the respondents to take an appropriate policy decision or to modify the policy decision in accordance with law.

With the aforesaid observations and directions, we dispose of the Writ Petition with no order as to costs. The points raised in the Writ Petition are kept open. Judge Judge |hedau|
