08.07.2024 The writ petition was filed because the post of Appellate Authority under the Employees' Provident Funds and Miscellaneous Provisions Act, 1952, at Nagpur was lying vacant. Though the petitioner has preferred appeal, he was required to approach under writ jurisdiction for interim relief, which has been granted.

The petitioner intends to prosecute the appeal as and when the officer is appointed.

In the circumstances, the interim relief stands continued till the application under Section 7-O of the Act of 1952 is decided by the authority. I am informed that, while granting interim relief, the petitioner was directed to deposit 25% of the disputed amount of assessment, which order has been duly complied.

Registry shall transfer this amount to the respondent authority.

With the above clarification, the writ petition is disposed of.
