The proposal of the petitioner, a Educational Institution for specially abled, for allotment of "E" class land to the extent of 0.16 H.R., out of Survey no.26 at Mouje Badnera recommended by the respondent no.2-Divisional Commissioner to the respondent no.1- State Government came to be rejected on 20th June, 2017, having regard to the Government Resolution dated 12th July, 2011.

But, for reference to the Government Resolution dated 12th July, 2011, no specific reason is furnished by the State Government for the said rejection though the proposal was recommended by the Divisional Commissioner.

That being so, the order impugned dated 20th June, 2017 is set aside for absence of valid and justifiable reasons. 5.

We permit the petitioner to appear before the Secretary, Department of Revenue and Forest Department, Mantralaya, Mumbai on 12th August, 2024 in the backdrop of recommendations dated 20th August, 2014 made by the Divisional Commissioner, Amravati.

We direct the State Government to take decision on the said proposal within four months from the receipt of this order.

The petition stands partly allowed.
