2] The learned Advocate for the petitioner submits on instructions that the petitioner would request the trial Court to frame a formal issue as to whether the added defendant No.4 can be said to be the son of deceased Vishnu Khasbage, keeping in view that the trial Court has observed in the order dated 6.1.2018 below Exh. 33 and also in the order dated 10.7.2019 below Exh. 56 that the parties will have to lead evidence to prove the status of the added defendant No.4. 3] In view of the above, this petition is disposed off as withdrawn. No costs.
