This is an application seeking condonation of delay of 68 days in filing the second appeal. It is stated that the appellant was suffering from Chikungunya, as a consequence of which, the appeal could not be preferred within the prescribed period of limitation. 03.

Although, the learned Advocate for the respondent opposes the application, having regard to the fact that the statement regarding ailment is made on oath, this Court is of the considered opinion that the delay deserves to be condoned.

The civil application is allowed by condoning the delay. 05.
