The petitioner was served with the order of punishment after disciplinary proceedings which was modified in revision vide order dated 15-1-2020 and the petitioner was given an opportunity to approach the Commandant in regard to the order "Dies Non". 3.

The petitioner thereafter approached the Commandant, who has passed the impugned order dated 05-10-2023 thereby treating the entry within the period wherein the petitioner was not on duty as "DIES-NON". 4.

In our opinion, the petitioner has an alternate remedy against the order of the Commandant which is impugned in the petition.

That being so, we deem it appropriate to dispose of the petition with liberty to the petitioner to take recourse of such alternate remedy.

In the matter of issue of limitation being cropped up, time spent in pursuing the petition shall be considered.
