The applicant has apprehension of arrest in Crime No.791 of 2025 for the offence punishable under Sections 318 read with Section 3(5) of the Bharatitya Nyaya Sanhita, 2023.

I have gone through the First Information Report. The FIR is lodged on 24.09.2025. In short, it is the case of the prosecution that the fraudulent representation was made by the accused persons to the complainant for delivery of 10 containers of rice and under pretext of supplying rice an amount of one crore was demanded. According to the FIR, amount of Rupees one crore was paid by the complainant to the accused in cash. Admittedly applicant has not accepted the said amount. At this stage, immediate custodial interrogation of the applicant is not necessary.

The learned Counsel for the applicant has further stated that the investigation is complete. The charge-sheet is filed. The case is committed. Further custodial interrogation of this applicant is not required. The applicant is attending the concerned Police Station and

2 9.aba.773.25 complied with the conditions imposed on him while granting protection. Hence, he prays to confirm the protection granted on 28.10.2025.

The learned A.P.P. conceded that the applicant is attending the Police Station regularly.

As the investigation is complete, further custodial interrogation of this applicant is not required. Hence, the interim protection granted on 28.10.2025 is confirmed on the same terms and conditions except a modification in the condition No.[6] that the applicant shall attend the Police Station as and when required by the Investigating Officer. Rest of the conditions are kept as it is.
