I have gone through the record and proceedings and the impugned judgment. Considering the grounds of appeal and considering the challenge to the impugned judgment, the applicant/appellant deserves an opportunity of redressal of his grievance on merit. 4.
In my opinion, the case is made out for grant of leave. As such, leave to appeal is granted. Appeal be registered.

On registration of appeal, issue notice to the respondent for final hearing at the admission stage, returnable within three weeks.

The criminal application stands disposed of accordingly.
