This is an application by respondent nos.1 to 4 for directions to the Registry/Nazir to permit the respondent no.3 -Vrushabh Ramesh Patil to receive amount on behalf of respondent no.4/Smt. Dwrakabai Patil. Learned Counsel for respondent no.1 to 4 submits that respondent no.4 is aged 88 years and on account of her old age and health issues she is not able to personally remain present for the purpose of receiving the amount deposited in this Court and for which she is entitled. It is submitted that respondent no.Vrushabh is her grand son and by virtue of power of attorney executed in his favour by respondent no.4, respondent no.3 may be permitted to withdraw the amount. 3.

Learned Advocate Mr. Kukdy for the appellant has no objection for this application.

Having regard to the contents of the application and submissions advanced, request appears to be reasonable. Considering the advanced age of respondent no.4 and considering the fact that the

2 ca3902.25.odt respondent no.3 is her grand son as stated on affidavit and also in the Power of Attorney, the application needs to be allowed. 5.

Registry is directed to allow respondent no.3 to receive amount on behalf of respondent no.4 after getting all the compliances completed from respondent no.3.
