Issue notice to the respondents. Mr. J. Y. Ghurde, the learned AGP waives service of notice for respondent No. 1 and Ms. Jaipurkar, the learned Counsel for respondent No.2. 3.

The substitution of the name of the petitioner No. 1 in place of the petitioner No. 2, whose name was originally included in the waitlist for compassionate appointment has been rejected by the impugned communication 4.11.2024 (page 13) on the ground that there is no provision. The position is already covered by the judgment of the learned Full Bench in Kalpana wd/o Vdilas Taram and another Vs State of Maharashtra and Others, 2024(4) Mh.L.J. 312, considering which the impugned communication is hereby quashed and set aside and the respondents are directed to act in accordance with the position as enunciated in Kalpana wd/o Vdilas Taram and another Vs State of Maharashtra and Others (supra).
