At the outset, learned counsel Shri R.R.Vyas for the applicant submits that he wishes to withdraw the present application with liberty to the applicant to file an application for grant of bail afresh, before Trial Court, after filing of chargesheet.

The criminal application is disposed of with liberty to the applicant to file an application for grant of bail afresh, before Trial Court, after filing of chargesheet which will be change in circumstance.

Learned Judge of Court below, before whom such bail application will be filed, shall decide the same on its own merits.

It is made clear that the case of the applicant is not heard on its own merits by this Court.
