Considering the short issue involved, RULE. Rule made returnable forthwith and heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondent nos.1 and 2. The presence of other respondents is not necessary considering the direction sought by the petitioner. The petitioner is the Secretary of Aastha Bahuuddeshiya Shikshan Sanstha. It is the case of the petitioner that in the proceedings before the Chief Judicial Magistrate, a settlement was arrived at in a pending litigation to which the Secretary of the petitioner-Sanstha was a party. As per Clause 1 of that settlement dated 15.03.2013 it was agreed that Mahatma Jyotiba Phule High School, Madgi would be transferred to the petitioner-Sanstha and other three persons named therein. Acting on that compromise the transfer has been effected.

Thereafter in the aforesaid matter, the Deputy Director of Education, Nagpur had conducted the hearing but according to the learned counsel for the petitioner there has been no further progress in those proceedings. The petitioner has therefore made two representations dated 23.07.2018 and 29.08.2018 to the Deputy Director of Education seeking redressal of the aforesaid grievance.

Since the aforesaid representations are pending before the Deputy Director of Education, it is directed that the same shall be considered and a decision thereon be taken within a period of four weeks from the date of the petitioner's appearance before the said respondent. The petitioner shall appear before the Deputy Director of Education on 01.08.2022 to facilitate consideration of those representations. The decision taken be communicated to the petitioner.
