Heard Shri T.G.Bansod, advocate for the applicants and Shri S.B.Bissa, A.P.P. for the non-applicant. The applicants are seeking pre-arrest bail apprehending arrest in the crime registered against them for the offence punishable under Section 379 r/w 34 of the Indian Penal Code. The accusations against the applicants are that the applicants have committed theft of motor pump. By the order dated 15th January, 2016, this Court granted interim protection to the applicants. The nonapplicant has not made any grievance that the applicants have misused the liberty. The non-applicant has not been able to show that the custody of the applicants is necessary for further investigation.

Considering the nature of the accusations and the facts on record, I am satisfied that the interim order passed by this Court on 15th January, 2016 is required to be confirmed, however, on certain conditions.

2 aba693.15 Hence, the following order :

In the event of arrest in connection with Crime No.174 of 2015 registered by the non-applicant, the applicants be released on bail on furnishing P.R. Bond in the sum of Rs.Ten Thousand each with one solvent surety in the like amount for each of the applicant.

The applicants shall attend the Police Station, Ner, District : Yavatmal daily between 10.00 a.m. to 1.00 p.m. until further orders.
