This application is for condonation of delay of 140 days caused in filing application for restoration of Criminal Writ Petition 424/2011.

According to the learned Counsel, the petition came to be dismissed in default since none was present for the petitioner.

For the grounds mentioned in the application,

2 appp234.18 sufficient cause is made out for restoration of the writ petition.

In the circumstances, the petition is restored subject to payment of costs of Rs.5,000/- to be paid to the High Court Bar Association, Nagpur within a week from today.

On payment of costs, Criminal Writ Petition No.424/2011 be restored to its file.
