Mr Khapre, learned senior counsel for the petitioner, restricts his claim in the petition to decide the claim of the petitioner for filling up the post. He contends, that the petitioner would be satisfied with a direction to the respondents to decide the claim for sanction of additional post, as the communication dated 17.09.2018 by the State, states that this cannot be done since there is a new policy to be brought into effect for the entire State.

What is material to note, is that the communication is dated 17.09.2018 and nearly a period of five years have passed since then. We, therefor, do not see any reason for not directing the respondents to consider the claim of the petitioner for grant of approval to additional post, considering the sanctioned strength. We, therefore, direct the respondents to consider the claim of the TAMBE

2 12 WP-8203-2019.odt petitioner and pass appropriate orders either way within a period of two weeks from today.

The petition is accordingly disposed of, in above terms. No cost.
