The rejection of an application moved by the petitioner for condonation of delay of 20 years in filing departmental appeal against the order passed by the Chief Executive Officer dated 07.09.2002 withholding five increments permanently, by the Additional Commissioner, which is the subject matter of challenge in this writ petition. 2.

The delay refused to condone by the Additional Commissioner on the ground that, no sufficient and satisfactory cause has been shown by the petitioner. 3.

On perusal of the application filed by the petitioner before the Additional Commissioner for condonation of delay, the reasons stated in the application are as follows :

13.wp.1175.24.odt "4. That, the appellant tried to contact several counsels, however the Counsel one or other count tried to avoid to file an appeal. In view of this, the appellant submits that there is a delay of 20 years in filing appeal." 4.

After going through the above referred reasons stated in the application, I do not find any error committed by the Additional Commissioner stating that no sufficient cause has been shown for condonation of delay. 5.

In that view of the matter, as there is no merit in the present writ petition, the writ petition is dismissed. JUDGE C.L. Dhakate
