NO. 129/2023 IN WRIT PETITION NO. 3428/2021 CORAM : REGISTRAR (JUDICIAL) DATED : 27/01/2023 The civil application is filed under Order V Rule 20 of the C.P.C., 1908 for subsituted service upon R.No. 3 by way of paper publication. As per bailiff's report, notice received back unserved with remark that noticee is not traceable. As per the application, the petitioner took every measure to inspect and search the fresh address of R.No. 3 but could not find the same. Thus, the petitioner prays for substituted service upon R.No. 3.

Hence, considering the reasons mentioned in the application and the bailiff's report, the petitioner is allowed to serve aforesaid respondent by substituted service on the last known address by paper publication.

Substituted service be effected upon aforesaid respondent by publishing a notice in widely circulated local daily newspaper "Dainik Bhaskar, Akola Edition" in terms of Order V Rule 20 (1-A) of C.P.C., returnable within four weeks from the date of publication of notice.
