Applicant is arrested on 11.07.2019 in connection with Crime No.252/2019 registered with Police Station Barshitakli, Tq.Barshitakli, Dist. Akola for an offence punishable under Sections 354-D of the Indian Penal Code read with Sections 8 and 10 of the Protection of Children From Sexual Offences Act.

Report is lodged by victim herself on 10.01.2019. As per her report, on the day of incident i.e. on 10.07.2019, when she along with her friends were coming from her school, two persons on motorcycle came and asked them, "

चल腔ꗽचल腔ꗽआम्ह敻研आम्ह敻研समो䦦䂾थ腔ꗽंबलोतुम्ह敻研य腔ꗽ." Thereafter, those two persons proceeded further and stopped at one place. When applicant and her friends also proceeded, at that time,

ba1094.19.odt one boy disclosed his identity as Mahesh Dhurandar, the present applicant and caught hold of the hand of the victim. The investigation is over. Charge-sheet is already filed. The applicant is in jail.

In view of above and looking to the entire prosecution case and the fact that the trial is not going to be decided at the earliest, further custodial presence of applicant is not necessary. Hence, I pass the following order.

ORDER

(i) The application is allowed.

(ii) Applicant-Mahesh Mohan Dhurandhar, be released on bail in connection with Crime No.252/2019 registered with Police Station Barshitakli, Tq. Barshitakli, Dist. Akola for an offence punishable under Sections 354-D of the Indian Penal Code read with Sections 8 and 10 of the Protection of Children From Sexual Offences Act, on he executing P.R. Bond in the sum of Rs.10,000/- with one solvent surety in the like amount.

(iii) Applicant shall attend Police Station, Barshitakli, Tq.Barshitakli, Dist. Akola twice a week i.e. on every Thursday and Sunday and shall be with the investigating officer from 02.00 p.m.to 05.00 p.m., till the trial is over. The application is disposed of.
