Heard learned Counsel appearing for the Petitioner/applicant.

The Petitioner claiming to be belonging to "Halba" Scheduled Tribe got appointed as an 'Assistant Teacher' from the Scheduled Tribe category. The claim of the Petitioner was referred for deciding the validity. His claim was invalidated by the Respondent No.1 Caste Scrutiny Committed on 09/05/2019.

The Petitioner/applicant, on instructions, has not pressed the challenge to the order impugned, whereby the claim for issuance for the validity was rejected. However, considering the fact that the Petitioner/applicant was in

2 11-WP No.3646.2019 employment of the Respondent No.2 from 09/10/1994, he is claiming his services be absorbed on supernumerary post. 4.

In this background, having regard to the existing policy reflected in various Government Resolutions, we permit the Petitioner/applicant to make a representation to Respondent No.2 - Zilla Parishad, for absorption of service on supernumerary post.

In case, if such request is made by the Petitioner/applicant to Respondent No.2, same be considered and decided within a period of six months from today. Till then no coercive action shall be taken. 6.

Accordingly, the Civil Application as well as the Writ Petition are disposed of.
