Heard learned counsel for the applicant.

This revision application challenges order dated 8.11.2014 refusing to reject plaint under Order VII rule 11 of the Code of Civil Procedure.

The applicant was defendant no. 3. It is alleged that the cause of action is said to have accrued only against defendants no. 1 and 2 who had grievance against plaintiff/respondent. However, applicant admitted that he was party to some complaints made in writing to various Authorities against respondent/ plaintiff. In view of this, he practically admitted that he is party to some complaints made against respondent. If the plaintiff-Company is saying that such complaints had caused loss to it and if it is seeking compensation for such loss, applicant/ defendant no. 3 is a necessary party.

Application stands rejected. No costs.
