Heard learned counsel for the rival parties.

There is a direct evidence against the applicant about his role in the assault. On the last date, since it was argued by learned counsel for the applicant that there is no applicant's participation in the assault and it is some other person whose name is mentioned in the statements of witnesses and FIR, this Court called upon the learned APP to find out the correct position. Today, the statements of witnesses recorded by the Investigating Officer during investigation are shown to me, in which the witnesses categorically state that the applicant is the same person but known by another

name "Sayyed Naeem". That being so, in the wake of evidence of eye-witnesses, it is not possible to grant anticipatory bail. Hence the following order:-

O R D E R

Criminal Application [ABA] No. 697 of 2015 is rejected.
