DATE :

20th January, 2016 Heard learned counsel for the rival parties. Seen the reply. Relevant portion of Para 2 of the reply is quoted below:- "2.

........................................................... ............The present applicant namely Balkrushna Wasekar was also residing in the same locality after 2-3 house. Being a neighborhood the present applicant used to talk with the father of the complainant, therefore the complainant was also acquaintance with the present applicant and they have developed love and affection with each other. In the month of July 2014 the applicant had expressed his deserved to marry with the complainant and for that the complainant was also agreed. Thereafter, she went to her grant-mother village Alapalli and resided their near about two months.

Thereafter, she came back at Chandrapur

and again they have started their friendship and developed intimacy with each other. ...."

From the reply, it is clear that it is not in dispute that the proposal for marriage with the major girl was also agreed to. But then, thereafter, the same fizzled out. In this background, therefore, looking to the girl being major, it would be appropriate to make the following order:-

O R D E R

Rule is made absolute in terms of the interim order dated 23rd December, 2015.
