Shri S.P. Deshpande, A.P.P. submits that the impugned order is revisable under Section 397 of the Code of Criminal Procedure and the revision application would lie before the Sessions Court. The judgment given in the case of Narayandas S/o Hiralalji Sarda and others V/s. State of Maharashtra and another reported in 2009(2) Mh.L.J.427 is pointed out.

Accepting the above submission and granting liberty to the applicants to avail appropriate remedy, the application is rejected. The interim order granted by this Court on 23rd October, 2018 shall continue till 30th November, 2018.
