This petition is filed on 21st December, 2015 challenging the order passed by the Appellate Authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (Collector). By the impugned order, the Appellate Authority allowed the appeal filed by the respondents 3 to 6, set aside the order passed by the SubDivisional Officer on 13th April, 2015 and remitted the matter to the Sub-Divisional Officer for deciding the complaint of the petitioner afresh.
The petition was pending before this Court till 11th April, 2016 on which date it was listed and order directing issuance of notice came to be passed. In response to the notice, the respondents 3 to 6 have put in appearance and have filed their submissions. The learned advocate for the respondents 3 to 6 has
2 wp1009.15 pointed out the order passed by the Sub-Divisional Officer on 25th February, 2016 disposing the complaint filed by the petitioner. The petitioner was under an obligation to point out this relevant fact on 11th April, 2016. Be that as it may, in view of disposal of the complaint filed by the petitioner by the SubDivisional Officer vide order dated 25th April, 2016 the challenges in this petition are rendered infructuous. The petition is disposed accordingly. The parties are at liberty to to avail appropriate remedy according to law.
