By order dated 26th July, 2017 this Court had granted protection to the applicant directing that in the event of his arrest in connection with Crime No.101/2016 he be released on bail. This Court imposed condition of attendance on the applicant and directed that after 9th August, 2017 the applicant shall attend the police station on every Wednesday till the filing of the charge-sheet. The charge-sheet is not filed till today.

By this application, the applicant seeks modification of the order dated 26th July, 2017 and prays that the condition of attending the police station on every Wednesday be relaxed. The applicant has placed on record all the documents to show that he has complied with the directions given by this Court and has

2 appp1765.18 attended the police station regularly. It is further pointed out that the State had filed Criminal Application No.3/2018 praying that the order passed on 26th July, 2017 be recalled and pre-arrest bail granted to the applicant be cancelled, however, by order dated 16th August, 2018 this application filed by State of Maharashtra is dismissed.

In the facts of the case, following order is passed:

The order passed by this Court on Criminal Application No.538/2017 on 26th July, 2017 is modified and the condition imposed on the applicant to attend the police station on every Wednesday is relaxed. The application is allowed accordingly.
