06th December, 2017 The applicant who has been arrested on 7th October, 2017 in connection with Crime No. 382/2017 registered at Padoli Police Station, Distt. Chandrapur, for the offences punishable under Sections 65-A and 83 of the Maharashtra Prohibition Act read with Section 188 of Indian Penal Code seeks his release on bail.

As per the report dated 7th October, 2017, a four wheeler was stopped on the basis of information received that liquor was being transported in the same. The applicant who was the driver of said vehicle was taken in custody as liquor worth Rs.5,00,000-00 was found therein.

It is submitted on behalf of the applicant that the applicant is not connected with the liquor that has been

seized. The owner of that liquor managed to escape and the applicant who was the driver of the vehicle has been implicated. As the liquor as well as the vehicle have been seized, the applicant deserves to be enlarged on bail.

The application is opposed by the learned Addl. Public Prosecutor. It is submitted that considering the value of the liquor seized, the applicant does not deserve to be enlarged on bail. The applicant is a resident of Bhilai [Chhatisgarh] and if released, he may not be available to face the trial.

Perused the police papers.

After the seizure of the liquor as well as vehicle and also arrest of the present applicant, the investigation in that regard is almost complete. Applicant is not shown to have any antecedents. Hence, a case for releasing him on bail is made out. Accordingly, the applicant who has been arrested pursuant to Crime No. 382/2017 registered at Padoli Police Station, Distt. Chandrapur, for the offences punishable under Sections 65-A and 83 of the Maharashtra Prohibition Act read with Section 188 of Indian Penal Code, is directed to be released on bail on furnishing a Personal Bond of Rs.20,000-00 [rupees twenty thousand only] with one local surety in the like amount. The applicant after his release shall furnish his

address and contact numbers to the Investigating Officer. He shall co-operate in the completion of the trial and he shall not take any steps to influence the witnesses.

The observations made in this order are only for deciding the application for grant of bail.
