The petition is against the interlocutory order passed below application for appointment of Court Commissioner under Order XXVI Rule 9 of the Code of Civil Procedure.

According to the learned counsel for the petitioner, the report of the Commissioner submitted is not conclusive and certain things are kept vague and unanswered. Hence, the application was moved for appointment of another Court Commissioner. The order is purely interlocutory in nature and it is open for the petitioner to challenge the said order in appeal if any such occasion arises. The writ petition is dismissed. No costs.
