This is an application to convert this petition in Appeal against Order under Order 43 Rule 1 (r) of Code of Civil Procedure. However, I am of the opinion that the petitioner be permitted to file afresh Appeal against Order instead of converting this writ petition. Accordingly, the writ petition is disposed of with liberty to the petitioner to file Appeal against Order under Order 43 Rule 1 (r) of the Code of Civil Procedure. 2.

The time period consumed in this writ petition from the date of filing of this writ petition till date, may be considered for of limitation.

The writ petition and civil application are disposed of.
