In the facts and circumstances of the case, we deem it appropriate to dispose of all the petitions with the following order:
2 4wp1083, 1084, 1085, 1086 and 1087 of 2016.odt (i) The petitioners, who are working as Anganwadi Sevikas were granted Pay Band of Rs.5500-9000 vide the Cabinet decision dated 18th September, 2008, vide Subject No.40.
(ii) The corresponding grade pay vide Government Resolution dated 27th February, 2009 as referred to in enclosure therewith the petitioners are claiming entitlement of grade pay of Rs.4300 vide Item no.3 paragraph no.3.2.2.
(iii) Accordingly, it is brought to our notice that the Commissioner, Integrated Woman and Child Development Scheme has made a recommendation to the Principal Secretary, vide recommendation dated 27th March, 2021 which are still pending consideration with the State Government. In this background, it is the contention of the petitioners that the Government is duty bound to implement its own decision. (iv) In view of above, we direct the Principal Secretary, Department of Woman & Child Development, Mumbai to take decision on the recommendation of the Commissioner referred above dated 27th March, 2021 thereby deciding the claim of the petitioners about their entitlement of grade pay as recommended, as expeditiously as possible and in any case within a period of three months from the date of production of this order. (v) Rest of the issues as claimed by the counsel for the petitioners already stood redressed.
