DATE : 02.07.2015 Heard the learned Counsel for the rival parties. Contesting respondent no.1, though served is absent. Undoubtedly, by interim order, stay was granted by the lower appellate Court on 18.10.2014 in Criminal Appeal No.75/2014. This Court granted interim stay on 6.1.2015 to the said order. In the above background and looking to the matrimonial dispute, it would be appropriate to pass the following order.

ORDER

(i) Criminal Writ Petition No.1088/2014 is disposed of.

(ii) Criminal Appeal No.75/2014 shall be decided by the lower appellate Court within a period of three months from today.

(iii) The petitioner to take Hamdast and serve on the appellate Court.
