The respondent was prosecuted for the offence punishable under Sections 138 of the Negotiable Instrument Act. After full-fladge trial, the learned Magistrate held that the complainant/appellant has failed to establish essential ingredients to make out a case. Hence, the respondent was acquitted.

Being aggrieved by said order, this appeal is of original complainant. The appellant has sought leave to file appeal on which notice was issued to satisfy whether there exist sufficient ground to grant leave.

Record indicates that time and again, the matter was placed, however, appellant remained absent. On last date on 21.06.2021, this Court has noted the past record and listed this matter today under the caption of dismissal.

In above scenario, the appellant is also absent. He is not interested in prosecuting the matter. In view of this. Applications stands dismissed. JUDGE Gohane.
