DATED : October 09, 2019 Pursis vide Stamp No.9390/2018 has been filed on behalf of the respondent no.1 stating therein that the sole plaintiff expired on 25.03.2018. The legal heirs have not been brought before the trial Court.

In view thereof, it is apparent that the proceedings in R.C.S.No.69/2012 have abated. The trial Court is free to pass orders in that regard. As a consequence, the proceedings in the present writ petition are rendered infructuous. The writ petition is therefore disposed of as having been rendered infructuous. Needless to state that is is open for the legal heirs to take such steps as are permissible in law in case the suit is restored.
