The short issue which is placed before me is that the petitioner no.1/accused no.8 was released on bail on 19.09.2025, whereas the petitioner no.2/accused no.9 was released in the month of March, 2025, and non-bailable warrant is issued against them on 30.09.2025. 3.

It appears from the roznama that the petitioner no.1 in custody and therefore, he was not produced before the Court by the jail authorities. It further appears from the Rgd.

Order 1310wp834.25corrected roznama that petitioner no.1 was present on 26.08.2025, 03.09.2025 and 17.09.2025. It also appears that on 30.09.2025 petitioners were absent, and therefore, nonbailable warrant has been issued. 4.

Today during the course of hearing, the learned Counsel for petitioners submits that the petitioners undertake to appear before the Court tomorrow i.e. 14.10.2025, and will make an application for cancellation of non-bailable warrant. He further undertakes that in future also they will promptly attend the Court proceedings.

Considering this undertaking of petitioners, I deem it appropriate to permit them to appear before the Additional Sessions Judge, Darwha, and the said Court shall consider the application of the petitioners, taking into consideration the undertaking given by them.

Criminal Writ Petition is accordingly allowed and disposed of.
