DATED : JANUARY 14, 2020 At the outset and before making submission in support of the election petition, the petitioner appeared in person and pressed the present application, which is an application seeking deletion of parties and formal amendment of the petition. 2.

It is stated in the application that the petitioner does not wish to press the prayer clauses No.5 and 6 in the election petition and further that he desires to correct the address and description of the respondent No.1, as according to the petitioner, the respondent No.1 was acting Chief Minister and now he is only a member of legislative assembly and leader of the opposition. The petitioner also seeks deletion of respondents No.2 to 23 from the array of respondents in the election petition as he has already submitted that he does not wish to press prayer clause No.5 in the election petition. A statement is also made that the

2 ep14.19.odt petitioner seeks to delete paragraph No.58 of the election petition, which is relatable to prayer clause No.6 of the election petition of which he is seeking deletion by way of this application.

In view of statement made in the application, the same is allowed at the risk of the petitioner. Consequently, paragraph No.58 of the election petition as well as prayer clauses No.5 and 6 are deleted. Similarly, respondents No.2 to 23 are deleted from the array of respondents.

Election Petition No.14/2019 :

Heard the petitioner in person.

It is claimed in the election petition that the sole respondent i.e. returned candidate indulged in corrupt practices, thereby vitiating the election, as a result of which declaration in favour of the sole respondent as returned candidate deserved to be set aside.

Issue notice, returnable on 14/02/2020.
