Learned counsel Shri M.P. Kariya opposes the application for condonation of delay as according to him the delay is not properly explained. The appellant-acquiring body has shown its bona fides by depositing the entire amount of compensation. In view of above and for the reasons disclosed in the application, the application stands allowed in terms of prayer clause.

Learned counsel Shri M.P. Kariya waives notice of hearing on behalf of the respondents.

The appellant to file private paper book within a period of six months, failing which the appeal shall stand dismissed without further reference to the Court.

C.A.F. NO.730/2017.

In view of deposit of the amount of compensation, the order of stay granted by this Court on 14.08.2017 stands confirmed. Liberty to the respondent-land owner to apply for withdrawal of the amount. The application is disposed of.
