Learned counsel Shri Sagar Katkar for the applicant seeks to withdraw the present application since according to him, due to change in circumstance in the nature of losing applicant's job, the applicant is required to move an application under Section 127 of the Code of Criminal Procedure before learned Magistrate. The prayer is just. Hence, it is accepted.

The criminal application is disposed of as withdrawn with a liberty to file a proper application under Section 127 of the Code of Criminal Procedure before learned Magistrate.

It is clear that this Court has not heard the applicant on its merits. All the points raised in the application are kept open.
