Learned Counsel for the makes a statement that the petitioner instead of depositing 50% of amount as directed by the District Court by order dated 22.11.2022 passed below Exh.5 in Regular Civil Appeal No.205/2021, would furnish security to the extent of the said amount. 2.

Perusal of the impugned order indicates that his submission was never made before the first Appellate Court in order to enable the Civil Court to pass any order in that regard.

Learned Counsel for the petitioner seeks leave to move appropriate application before the Appellate Court for modification of order dated 22.11.2022 permitting him to furnish security instead of deposit of 50% amount. 4.
