Heard.

The appellant, who is original complainant instituted ten proceedings under section 138 of the Negotiable Instruments Act, 1881. The accused is acquitted in all the ten prosecutions. In the present appeal, the judgment and order impugned in one of the ten proceedings to wit Criminal Case 5509 of 2014 is assailed. The complainant and the accused have settled their inter-se dispute in all the ten appeals. Compromise Terms which are recorded on 15.1.2018, are signed by both the appellant Dr. Tikamdas Tahilani and the respondent Shri. Mukesh Bhawanani. The learned counsels Shri Sahil Dewani and Shri S.B. Chanchlani have identified their
