DATE : 07.09.2015 By this petition, the petitioner challenges the order of the respondent - Bank dated 3.12.2014, terminating the services of the petitioner. The petitioner also seeks a direction to the respondent to permit the petitioner to join his duties till the final disposal of the industrial dispute filed before the appropriate Government.

It is not in dispute that the proceedings are initiated before the C.G.I.T., Nagpur in pursuance of the provisions of Sections 2-A, 10 & 12 of the Industrial Disputes Act. Merely because the petitioner is not able to secure the interim relief in the said proceedings, the petitioner cannot be permitted to file the writ petition, seeking a direction to the respondent - Bank to permit the petitioner to work on the post from which he is terminated during the pendency of the dispute before the C.G.I.T. In the aforesaid circumstances, the writ petition is dismissed with no order as to costs.
